Public nuisance defendant no-shows Municipal Court

Darnel Davis, 1039 Fayette Drive, Hazen, was summoned to appear in Hazen Municipal Court last Tuesday to answer a public nuisance charge filed by the city July 25, 2014, and failed to appear to answer the charge.
According to the summons, the city claimed Davis was in violation of “Section 12.02, ChapterXXII, Article 1, of the Hazen City Ordinances and against the peace and dignity of the said City of Hazen.”
City Planner Steve Frovarp said Davis was issued a permit June 3, 2014, to build a garage on the property. Since that time, Frovarp said the property had become unsightly with items stacked under a tarp-covered area on the property.
Davis told Frovarp in previous conversations the items under the tarp would be placed in the garage.
In the court documents, it was written had the garage been constructed in a timely manner and the items placed in the garage and the tarp-covered area removed, neighbors may have been satisfied and not [appeared] at the July 7, 2014, city commission meeting to complain.
