One ruling in a case involving the 2012 shooting death of a man in Beulah was overturned last week.
Last year, Cody Borner and Richard Whitman were both charged with conspiracy to commit murder after a shooting that left Michael Padilla dead and Timothy Padilla wounded. After appealing the case to the North Dakota Supreme Court, the jury conviction was reversed by the Supreme Court last week in a 3-2 decision.
Justice Mary Muehlen Maring led the reversal of the criminal judgment in the official ruling, noting that the court held that the charge of conspiracy to commit murder under two sections of state century code to not be a cognizable offense.
