ND supreme court grants supervisory writ in Napora, Desjardins case
A district judge is being directed by the North Dakota Supreme Court to reverse orders denying motions to dismiss criminal charges in a case stemming back to February of 2023.
“We conclude Judge Lee misinterpreted the compromise statutes and abused his discretion in denying dismissal under N.D.R.Crim.P. 48(a),” the Supreme Court stated in a ruling issued Sept. 11. “We exercise our supervisory jurisdiction, grant the State’s petition for a supervisory writ, and direct Judge Lee to reverse the orders denying the motions to dismiss criminal charges with prejudice against Defendants.”
